Johnson & Johnson Agrees $5.5bn Talc Lawsuit Settlement

Johnson & Johnson has announced an estimated $5.5bn settlement to resolve tens of thousands of legal claims. These lawsuits allege that the company's talc-based baby powder and other products led to ovarian cancer. This agreement aims to conclude a contentious legal battle that has spanned a decade.

The proposed settlement encompasses approximately 76,000 claims, including those consolidated in a federal court in New Jersey and related state court cases. This represents nearly all outstanding talc-related claims against the company. Johnson & Johnson had previously settled the majority of cases alleging its talc contained asbestos and caused mesothelioma.

Company's Stance and Payment Schedule

Erik Haas, Johnson & Johnson's vice-president of litigation, stated that the company views the claims as "meritless" but is settling to achieve closure. He added that while confident in prevailing in further litigation, this resolution allows the company to focus on its mission. Johnson & Johnson anticipates paying $3bn in 2027, with additional payments in 2028. The final payout could exceed $5.5bn depending on claimant participation.

Chris Seeger, a lawyer representing about 2,500 clients with talc claims, helped negotiate the agreement. He indicated that the total payout could reach $7bn or more, as the settlement assigns specific values to qualifying ovarian cancer claims without capping the overall expenditure. Seeger expressed satisfaction, stating, "We got a fair settlement, and our clients are going to be happy with it."

Background to the Settlement

This settlement follows a series of legal victories for Johnson & Johnson, including successful trials, disqualification of some plaintiffs' lawyers, and rulings against expert witnesses. A federal judge recently cast doubt on individual plaintiffs' ability to prove talc specifically caused their ovarian cancer. The company has consistently denied that its talc products cause cancer, asserting their safety and absence of asbestos.

Johnson & Johnson ceased selling talc-based baby powder in the US in 2020, transitioning to a cornstarch-based product. Litigation had resumed in March 2025 after being paused for over three years during unsuccessful attempts by the company to settle cases through bankruptcy filings via a subsidiary. These bankruptcy efforts were ultimately dismissed.

Prior to these bankruptcy attempts, Johnson & Johnson had a mixed record in talc trials, including a multi-billion dollar verdict favouring 22 women who claimed baby powder caused their ovarian cancer. Some verdicts were later reduced on appeal. The current agreement exclusively addresses existing claims and does not cover future lawsuits.

Finalisation of the Deal

For the settlement to become final, it must be approved by 95% of the ovarian cancer claimants involved in either state or federal court proceedings. Lawyers noted that the exclusion of future claims makes more funds available to current plaintiffs compared to previous bankruptcy proposals. Additionally, the payment schedule accelerates, with all claims expected to be settled within 18 months.
