Speaking at a press conference, Mrs Badenoch stated that new prison capacity needs to be developed more rapidly and affordably. She highlighted that community acceptance is crucial for the establishment of new sites, noting that judicial challenges have previously caused delays. Mrs Badenoch suggested that if communities consistently oppose potential prison locations, the necessary infrastructure will not be built. She also proposed that the government should consider renting prison spaces abroad, a practice previously undertaken by the UK and employed by countries like Sweden with Estonia. Furthermore, she advocated for the repatriation of foreign nationals to correctional facilities in their home countries, suggesting that leaving the European Convention on Human Rights would facilitate such removals.

Mrs Badenoch challenged Andy Burnham's assertion of pausing the early release programme, stating that genuine action would involve revoking the commencement order and introducing emergency legislation by September 2. Mr Burnham, however, stated his commitment to minimising public risk and attributed the current overcrowding to the previous government's failure to construct adequate prison capacity. He confirmed that the September releases are on hold pending an urgent review.

Mrs Badenoch acknowledged the difficult prison situation but asserted that her party did not implement early releases for individuals convicted of serious crimes such as murder, rape, or paedophilia. She mentioned that during their time in government, 14,000 new prison places were created, though this was insufficient, and a manifesto target for prison construction was disrupted by the COVID-19 pandemic.

The controversy intensified following revelations that two individuals connected to the death of PC Harper might be eligible for automatic release under the scheme. PC Harper died in 2019 after being dragged for a mile while attached to a car fleeing a burglary. Lissie Harper, his widow, described the policy as "deplorable" and criticised politicians for making decisions with significant consequences for victims' families without fully understanding the impact.
