Fly-tipping in Barnet: £500 for a first offence, £350 if you pay quickly

Barnet operates an escalating penalty structure for fly-tipping, which is worth understanding because it means the second offence is treated very differently from the first, and the third differently again.

The penalties

A first fly-tipping offence carries a fixed penalty of £500, reduced to £350 if paid within fourteen days. A second offence is £600, reduced to £570 — note that the discount is much smaller the second time. A third offence is not offered a fixed penalty at all: it goes to prosecution.

Littering is £250, or £175 if paid within fourteen days. Dog fouling is £100, or £70.

What a fixed penalty actually is

It is an offer to settle rather than a fine imposed by a court, which is why declining it does not end the matter. If a fixed penalty is unpaid after twenty-eight days, Barnet issues a court summons and a magistrate decides — where the penalties available are considerably higher than the fixed penalty was.

Reporting a tip

Report through the council’s street care and cleaning pages. Give the location as precisely as you can, and what the tip consists of — a photograph helps if it is safe to take one, particularly if anything in the pile identifies where it came from.

One thing Barnet does not publish is a clearance target. Several London boroughs commit to a number of working days; Barnet does not state one, so there is no published standard to hold a slow response against.

The duty that catches householders

If you pay someone to take waste away and they fly-tip it, you can be penalised — the duty of care requires you to check that whoever takes your waste is a licensed carrier. A cheap van quoted on social media is exactly the situation the duty exists for. Ask for the carrier’s registration number and check it before the waste leaves.
